House Bill (HB) 3928

Austin ISD, Dept. of Special Education Services

August 10, 2023

Per HB 3928, dyslexia and/or related disorders is considered a specific learning disability (SLD) under the Individuals with Disabilities Education Act (IDEA). Parents have a right to request an evaluation through special education if they suspect their child has dyslexia (or another disability). Evaluations through the special education process make sure that students who are eligible for special education services are identified and provided the support they need. Students are not evaluated or admitted into special education without parent consent.

If your child receives Section 504 services and is identified with dyslexia and/or dysgraphia, please contact your child’s school principal or campus Section 504 coordinator if you would like to request an evaluation through special education evaluation for dyslexia and/or related disorders (i.e., dysgraphia).

Additionally, if your child is currently receiving Section 504 services and receives direct dyslexia instruction, your child's campus 504 coordinator will be contacting you during the 23-24 school year to determine whether your student continues to require an evidence-based dyslexia program. If so, the campus will refer the student for an evaluation through special education. In these cases, the student will continue to receive instruction through an evidence-based dyslexia program while awaiting parental consent for the special education evaluation, its completion, and any subsequent eligibility determination.

Also review the recent TEA guidance on Dyslexia Evaluation, Identification, and Instruction - House Bill (HB) 3928. More information will be provided as we receive guidance from the Texas Education Agency and the State Board of Education.
